Pick A Pack Promotion - Terms and Conditions


  1. Instructions on how to claim gift cards form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions. Offer not valid in conjunction with any other offer. By submitting a claim in this promotion, claimants acknowledge that they have read, understood and accepted these Terms and Conditions.

  2. Promotion commences on 9am AEDST 9/1/23 and ends at 11.59pm AEST on 30/4/23 (“Purchase Period”)

  3. Promoter is NHP Electrical Engineering Products Pty Ltd (NHP) ABN 84 004 304 812.

    4. Eligibility to Claim

  4. Claims are only open to Australian residents who are licensed electrical contractors.

  5. Employees (and their immediate families) of the Promoter, retailers, wholesalers and agencies associated with this promotion are ineligible to claim. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, stepparent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, stepbrother, stepsister or 1st cousin.

  6. To be eligible to claim, eligible claimants must, during the Purchase Period, purchase a specially marked NHP ‘Pick a Pack’ pack (“Participating Product”). Participating Products are strictly limited and only available while stocks last. Inside each specially marked pack there will be a promotional voucher.

    7. How to Claim

  7. Claimants must, before the end of the Promotion Period, submit their claim online by visiting www.NHP.com.au/pickapack (“Website”), complete the online claim form, inputting the requested details, including voucher code(s) from the promotional voucher(s).

  8. Only one claim per promotional voucher code is permitted.

  9. Once the claimant provides their requested details, they will be sent via email a GiftPay™ gift card.

  10. The value of the gift card is specified in the table below;

  1. Once the gift card is sent to the claimant, the claimant agrees that they will then be bound by the gift card terms and conditions of GiftPay™ https://www.giftpay.com.au/business/

    2. General Terms

  2. Claimants must retain all of their promotional voucher(s) as proof of purchase. Failure to produce proof of purchase when requested by the Promoter, may result in the invalidation of all of their claims, and any right to any gift card.

  3. The Promoter reserves the right, at any time, to verify the validity of claims and claimant’s (including a claimant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these terms and conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter's discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter's legal rights to recover damages or other compensation from such an offender are reserved.

  4. Claims may be subject to follow up enquires or investigations or security and verification checks as the Promoter determines to apply in its absolute discretion. Claims will be ineligible if promotional vouchers (and voucher codes) are mutilated, illegible, stolen, forged, reconstructed, altered, incomplete or tampered with in any way, or if these documents fail any of the Promoter’s security and verification checks.

  5. Multiple claims permitted for multiple purchases only. Each claim has to be submitted separately on the Website.

  6. If there is a dispute as to the identity of a claimant, the Promoter reserves the right, in its sole discretion, to determine the identity of the claimant.

  7. The Promoter’s decision is final and no correspondence will be entered into.

  8. Claims must be successfully verified by the Promoter before a gift card will be awarded. The Promoter accepts no responsibility for any variation in the gift card value.

  9. The Promoter shall use all reasonable efforts to ensure that all approved claims will be fulfilled within two (2) weeks from the time the claim is submitted. The Promoter accepts no responsibility should the delivery take longer than two (2) weeks for reasons beyond its reasonable control.

  10. Claimants are required to provide all details requested by the Promoter. In the event that a claimant fails to provide any of the details requested, the claim will be invalidated and no corresponding gift will be awarded to that claimant.

  11. Claimants must have fully paid for the Participating Product before they are eligible to submit a claim.

  12. Claimants are responsible for ensuring that they provide the Promoter with accurate details relating to their claim. In the event that a claimant provides any incorrect details on their claim, the Promoter shall not be liable for the gift card not being awarded or being delivered to the wrong address. In either of these cases, the gift card will be forfeited by the original claimant and no additional gift card will be awarded.

  13. Gift cards are not transferable or exchangeable and cannot be taken as cash.

  14. Claimants consent to the Promoter using their name, likeness, image and/or voice in the event they are a successful claimant (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any claimant; or (b) to modify, suspend, terminate or cancel the promotion, as appropriate.

  15. Any cost associated with accessing the Website is the claimant’s responsibility and is dependent on the internet service provider used.

  16. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the State and Territories of Australia (“Non-Excludable Guarantees”). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the promotion.

  17. Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of: (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in gift card value to that stated in these Terms and Conditions; (e) any tax liability incurred by a claimant; or (f) use of a gift.

  18. The Promoter reserves the right to extend the promotion without notice and at their discretion.

  19. The Promoter collects personal information ("PI") in order to conduct the promotion and may, for this purpose, disclose such PI to third parties, including but not limited to agents, contractors, service providers and gift card suppliers. Entry is conditional on providing this PI. The Promoter will also use and handle PI as set out in its Privacy Policy, which can be viewed at www.NHP.com.au. In addition to any use that may be outlined in the Promoter’s Privacy Policy, the Promoter may, for an indefinite period, unless otherwise advised, use the PI for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the claimant. The Privacy Policy also contains information about how claimants may opt out, access, update or correct their PI, how claimants may complain about a breach of the Australian Privacy Principles or any other applicable law and how those complaints will be dealt with. All claims become the property of the Promoter. The Promoter will not disclose claimant’s personal information to any entity outside of Australia.
